246 Millennium - A Marquis Who’s Who Magazine LAW AND LAW ENFORCEMENT C onsumed by an interest in politics and history in his formative years, Kenneth Ralph Kirby soon found the legal industry was the perfect fit for his skillsets. Now holding immense expertise in appellate advocacy and insurance defense, he is most notable for his role in the school desegregation lawsuit, Arthur v. Nyquist 716 F. Supp. 1484, WDNY 1989. As a member of a team that replaced a group of attorneys who previously lost the fight with the school board over funding, Mr. Kirby notes that the lawsuit revolved around the school board demanding more money for desegregation. Notably, his team was the first to shut out the board. Upon his admittance to the New York Bar in the 1980s, Mr. Kirby served as an associate at O’Shea, Reynolds, Napier, Quinn & Cummings in Buffalo, New York, for three years until being promoted to partner in 1987. Excelling in the role until 1993, he went on to serve Napier, Fitzgerald & Kirby from 1993 to 2006, Wilder & Linneball LLP from 2006 to 2007, and Mattar D’Agostino & Gottlieb LLP from 2007 to 2008. Additionally, between 2006 and 2011, he served of counsel with Lippes, Mathias, Wexler, Friedman LLP. Since 2012, Mr. Kirby has been an assistant attorney for Eric County in Buffalo. To prepare for his career, Mr. Kirby attended the State University of New York at Buffalo, graduating cum laude with a BA in 1979. Completing additional coursework at Georgetown University from 1979 to 1980, he subsequently earned a JD from the University of Buffalo in 1982. He is admitted to practice before the U.S. District Court for the Western District of New York, the U.S. Court of Appeals for the Second District and the Supreme Court of the United States. Demonstrating versatility in his field, in 1994, Mr. Kirby published the article “The Six-Year Legal Malpractice Statute of Limitations, Judicial Usurpation of the Legal Prerogative?” in the New York State Journal, which resulted in the amending of the statute through the New York State Legislature.
